Department for Environment, Food and Rural Affairs pilot project

Kent County Council is taking part in a pilot project that will help to modernise the information in the Registers of Common Land and Village Greens.

We are one of seven ‘Commons Registration Authorities’ taking part in the project.

New legislation in Part I of the Commons Act 2006 means that we can now amend the Registers of Common Land and Village Greens, making them more up to date and relevant for day-to-day use.

The new provisions enable applications to be made for the following purposes:

  • 'Contemporary applications' to record an event which has taken place after 1 October 2008 - for example, to record the creation of a new right of common to graze animals on registered common land
  • 'Rectification applications' to correct a mistake or omission on the Registers - for example, to de-register wrongly registered common land or village greens
  • An initial 'transitional application period' during which applications may be made for the Registers to be amended to reflect relevant events that have taken place prior to 1 October 2008, but have not been formally recorded on the Registers.

The new legislation took effect in Kent on 1 October 2008 and is due to be rolled out nationally from October 2011.
