Planning legislation

Planning is a statutory process governed by the Town and Country Planning Act 1990.

The county council, Medway Council and borough and district councils all have a statutory duty to carry out proscribed planning functions.

The implementation of the Planning Act is supported by instruments and circulars issued by central government. Government also provides guidance to assist councils with their duty.

The planning system is currently undergoing change as government moves to enhance the regional role of planning in our society.

Recent legislation such as the Local Government Bill and the Compulsory Purchase and Planning Bill has affected the role of the county council.
