Right to Challenge process
1. KCC opens up services for expressions of interest
Right to Challenge applies to most of the services that Kent
County Council provides (there are some exceptions set out in
the
statutory guidance). The right only applies to the
provision of services, it does not provide for delegation of the
functions of a relevant authority. The responsibility for the
function itself remains with the relevant authority.

The Expression of Interest Register provides some information
about the service and provides links to additional information such
as business plans and the Budget Book. This will help you to assess
whether your organisation could provide or assist in providing the
service.
The maximum period between the date we receive your
expression of interest and the date by
which we will notify you of our decision on it is 26 weeks. We will
make the decision more quickly than this where possible. We will
notify you of the exact date by which we will let you know our
decision in writing within 30 days after the close of the
expression of interest window for the service.
If no expressions of interest are received within the time
window we will continue providing the service as it is currently
provided. However, we may consider the best value options available
in the future.
To find out about opportunities to bid for upcoming contracts
for KCC services that are already externally provided, please visit
the Kent Business
Portal. Expressions of interest will be considered in the 6
months before the current contract ends. Please use the
Right to Challenge Expression of Interest form to submit an
expression of interest for these services.
