Leasing and letting advice
Essential reading if you would like to allow external
groups such as a pre-school, nursery, music club or brownie/cub
packs to use space within the school, or land within the school
grounds.
A local hiring agreement is sufficient if a group wishes to use
a room or the school hall for a short period of time each week, for
example, every Thursday night. However, a formal lease is required
if a group is to be given exclusive use of one or more rooms within
the school.
A lease defines the area that can be occupied and any other
rights that have been agreed, e.g. use of the school playground. It
will also set out who is responsible for any costs,
maintenance/repair and insurance.
Setting up a lease protects the school’s legal interests. If a
group is allowed to occupy part of the school without one there is
a risk they could gain a secure tenancy making it difficult to get
them to leave if required. The requirement for a lease also applies
if a group is to be allowed to place a building on land within the
school grounds.
KCC Schools
The lease needs to be made between KCC and the third party
group. Property Group will negotiate the lease on the school’s
behalf.
Foundation Schools
As the buildings and land have been transferred to the Governing
Body, KCC does not need to be involved. However Property Group can
provide advice and guidance if required.
Church Schools
KCC may need to be involved as only the buildings and hard play
areas have been transferred to the Diocese.
