Protection Policy, Protocols and Guidance for Kent and Medway

  This document has been developed to provide a framework to enable local authority staff and a range of other agencies to work in partnership with providers of social or health care services, where poor practice and/ or quality concerns have been identified.

• Multi-Agency Adult Protection Policy, Protocols and Guidance for Kent and Medway
  This has been developed to meet the requirements of the 'No Secrets' Department of Health guidance and to support good practice in adult protection. 

• Additional Multi-Agency protocols
  This document provides additional guidance to support agencies and services to respond to abuse of vulnerable adults by other vulnerable adults.

• Joint Police, Social Services And Health Protocol for Dealing With Cases of Domestic Violence Where Vulnerable Adults Are Involved (PDF, 156k)
  This document forms the first guidelines to be developed to assist Police, Social Services and where appropriate health services to work together to address the issues of Domestic Violence where they affect Vulnerable Adults.

Acts of UK Parliament about Adult Safeguarding

The following legislation has been passed by Parliament to protect vulnerable adults.

• Fraud Act 2006
  This came into force on 15th January 2007. It removes all deception offences from the Theft Acts of 1968 and 1978. It provides a formal definition of the single criminal offence of fraud. Section 4 of the Fraud Act is the most significant for vulnerable adults as it provides an offence of Fraud by abuse of position.
  

• Mental Capacity Act
  The Mental Capacity Act 2005 includes the new offence of ill-treatment or neglect of a person who lacks capacity.

• Domestic Violence Crime and Victims Act 2004
  This includes the addition of the offence of causing or allowing the death of a child or vulnerable adult through abuse/neglect.

• Sexual Offences Act 2003
  This came into force on 1st May 2005 and includes a range of new offences and provides harsher sentences for sexual offences against children and vulnerable adults.
  
  It also provides new measures to strengthen and monitor offenders.
